On November 6, the Royal Thai Government Gazette published the Labour Protection Act (No. 9), B.E. 2568. The key provision states that a female employee who is pregnant is entitled to maternity leave of up to 120 days per pregnancy, or as otherwise specified in a Royal Decree.

 

Under the previous law, female employees were entitled to 98 days of maternity leave (90 days for childbirth and an additional 8 days for prenatal checkups). During the 90 days of childbirth leave, employees received 100% of their salary from the employer for 45 days, and 50% of their salary from Social Security for the remaining 45 days. Under the new law, female employees are entitled to up to 120 days of maternity leave per pregnancy. The employer is required to pay 100% of the employee’s salary for up to 60 days, while the remaining days can be covered under Social Security benefits.

 
In the case of a female employee who takes maternity leave for childbirth, she is entitled to an additional continuous leave of up to 15 days to care for her child if the child is ill, at risk of complications, has abnormalities, or has a disability. A medical certificate must be presented to support this leave.

In the case of a female employee who takes maternity leave for childbirth, she is entitled to an additional continuous leave of up to 15 days to care for her child if the child is ill, at risk of complications, has abnormalities, or has a disability. A medical certificate must be presented to support this leave.

 

In addition, employees are also entitled to take leave to assist their spouse who has given birth, for up to 15 days, which can be taken either before or within 90 days from the date of childbirth.

 

The revised Labor Protection Act, granting 120 days of maternity leave, has been officially published in the Royal Gazette and will come into effect in 30 days. Key provisions include increasing maternity leave from 98 to 120 days, allowing spouses to take up to 15 days of leave to assist with childcare, permitting an additional 15 days of leave if the child is sick, and extending labor protections to contract workers in the public sector.
